Terms & Conditions
As a registered Member of Ufly Rewards Plus (“Member”), you agree to abide
by these Terms and Conditions, and when ordering anything from a supplier of products
or services (a "Supplier"), you agree that these Terms and Conditions shall apply
to your order.

- 1. CLUB RULES
1.a. You are obligated to provide accurate and true information
when you apply for a Ufly Rewards Plus Membership ("Membership") and your
failure to do so may invalidate your Membership and any subsequent transaction.
Your responsibility to provide accurate information is a continuing obligation and
you must notify Ufly Rewards Plus in the event that any information provided
by you changes by using the contact information specified in Section 12.
1.b. Your Membership is non-transferable. You agree that only you
will use the Membership. You will promptly notify us by using the contact information
specified in Section 12 if you become aware of any unauthorized use of your Membership,
or if your Membership card is lost or stolen.
1.c. The Ufly Rewards Plus Family Membership is issued
to the Member, or "Administrator" for the purposes of identifying the family member
whose name appears on the account, and his or her "Immediate Family:"
i. Up to four (4) family members
are allowed on each account for a total of five (5) members per family membership.
ii. "Immediate Family" is defined
as the Member, his or her spouse or domestic partner, and children.
iii. Children must be 21 years of
age or under at the time of enrollment.
iv. All family members must live
at the same address.
1.d. Each Member will be administered one (1) Member card per year.
Lost, stolen, or additional Member cards requested by the Member will result in
a charge of $10 per request to the credit card number on file. Family Memberships
are administered one Member card to the "Administrator" of the account.
1.e. Ufly Rewards Plus reserves the right to refuse membership
to anyone for any reason.
1.f. Access to and use of the Ufly Rewards Plus Members
section of the Ufly Rewards Plus website ("Site") is through a combination
of user name and password or Ufly Rewards Plus Number and Pin, and is reserved
exclusively for Members. You are solely responsible for maintaining the confidentiality
of your user name and password or Ufly Rewards Plus Number and Pin, and
you agree to notify Ufly Rewards Plus immediately by using the contact
information provided in Section 12 if you believe that there has been any breach
of security (e.g. the unauthorized use of your name and password).
1.g. Members must present their Ufly Rewards Plus Card
at the airport in order to redeem Ufly Rewards Plus benefits at the airport.
1.h. All Members are bound by Sun Country Rules, Terms and Conditions,
and policies.
1.i. All Members are bound by Ufly Rewards' Rules, Terms
and Conditions, and policies.
1. j. All Members are bound by Ufly Rewards Plus' Suppliers'
Rules, Terms and Conditions, and policies.
1.k. Applicant must be a U.S. citizen with a valid U.S. credit
card in order to register for Ufly Rewards Plus.
- 2. MEMBERSHIP FEES, CANCELLATIONS, AND RENEWALS
2.a. The current single annual Membership fee is $144, which is
billed in 12, $12 monthly installments to your credit card, or annually for one
(1) $144 payment. You will be notified of any increase in the current annual Membership
fee and initiation fee on the Terms and Conditions page on the Ufly Rewards
Plus Site. Increases will take effect upon the annual renewal of your membership.
2.b. The current family annual Membership fee is $204, which is
billed in 12, $17 monthly installments to your credit card, or annually for one
(1) $204 payment. You will be notified of any increase in the current annual Membership
fee and initiation fee on the Terms and Conditions page on the Ufly Rewards
Plus Site. Increases will take effect upon the annual renewal of your membership.
Alternatively, membership price changes may following a 30 day notice.
2.c. There is an upfront initiation fee to join Ufly Rewards
Plus of $99.
2.d. There is a 30-day review period in which time you may cancel
your Membership. However, once a Ufly Rewards Plus Ticket has been booked, the Member
must fulfill their year long commitment and all first year Membership fees are required
to be paid. The Membership will not be eligible for cancellation until the end of
the first Membership year. Cancellation requests will not be accepted until your
initial year long commitment has been fulfilled and all first year Membership fees
have been paid.
2.e. Upon reenrollment in Ufly Rewards Plus after a lapse
in Membership of any period, another initiation fee will apply corresponding to
the current initiation fee structure.
2.f. Your Membership fee and initiation fee are non refundable
after the 30-day review period. However, Ufly Rewards Plus may, at its
sole discretion, elect to refund your Membership fee in whole or in part depending
on the circumstances relating to the cancellation of any Membership.
2.g. Ufly Rewards Plus reserves the absolute right to
cancel or suspend your Membership, at its sole discretion, for any reason whatsoever.
If Ufly Rewards Plus cancels your Membership, it will stop billing the
monthly Membership installment(s) for the remaining Membership period immediately
upon cancellation. No previously paid fees will be refunded.
2.h. Membership is effective for a period of twelve months following
the Membership enrollment date, and twelve months following the Membership renewal
date in subsequent years.
2.i. Your Membership will automatically renew to another annual
Membership after the first 12 months, and the credit card on file will be charged
accordingly, unless the Member contacts us in writing to cancel the Membership to
the address specified in section 12 below.
2. j. An updated Member card will be mailed to you approximately
30 days in advance of renewal.
2. k. Any increase in the annual Membership fee will take effect
upon renewal of your Membership. If you choose not to renew your Membership, and
your new Member card has been sent to you, cancellation will become effective once
we receive the new Member card at the address specified in section 12 below.
2.l. Members paying the monthly installments will not receive a
refund upon cancellation. Members are not entitled to a refund of past fees charged
to their account.
2.m. Only Members paying annually and have fufilled the one year
commitment are eligible receive any credit to their account upon cancellation. That
amount will be equal to the unused portion of the membership from the first of the
month following cancellation. Members are not entitled to a refund of past fees
charged to their account.
2.n. If you wish to cancel your Membership, you must mail a letter
with that request to the mailing address in section 12 below. You may also email
a request to cancel your Membership from the email address associated with your
account. Once the request has been received, Ufly Rewards Plus will determine
if your account is eligible for cancellation.
2.o. If you choose to convert your Membership to or from a family
Membership, any previously paid fees will not be refunded. In addition, your one
year Membership commitment will start over on the date of conversion.
- 3. Ufly REWARDS PLUS TICKET BENEFIT ON SUN COUNTRY AIRLINES
3.a.The current round trip Ufly Rewards Plus Ticket pricing
as of January 1, 2006 is $39 plus $.10 per mile for domestic flights and $89 plus
$.10 per mile for international flights. Mileage is calculated from the departure
airport to the arrival airport. You will be notified of any future increase in the
Ufly Rewards Plus Ticket pricing structure on the Terms and Conditions
page on the Site. Increases will take effect following 30 days notice. Any Ufly
Rewards Plus Tickets purchased prior to a change in pricing structure will be honored
as purchased at the time of booking.
3.b. Air travel purchased through the Ufly Rewards Plus
Membership ("Ufly Rewards Plus Tickets") is available to Members and their
registered family members only (as defined in section 1.c.). Abuse of Ufly
Rewards Plus Tickets will result in immediate cancellation of the Membership resulting
in immediate forfeiture of all related Membership fees.
3.c. Ufly Rewards Plus Tickets may be used by active Members
and their registered family members only, and must be booked through the Ufly
Rewards Plus Site.
3.d. All Ufly Rewards Plus Tickets purchased through the
Membership are subject to all terms and conditions set forth by Sun Country and
its affiliates as stated in the Terms and Conditions and Contract For Carriage on the Sun Country website.
3.e. Additional fees may apply to Ufly Rewards Plus Tickets
at the discretion of Sun Country Airlines. An example would be a charge for an Unaccompanied
Minor.
3.f. Ufly Rewards Plus Tickets may be purchased up to
one day in advance of travel based on Midnight Central Time. Ufly Rewards
Plus Tickets purchased less than one day in advance will not be eligible for Ufly
Rewards Plus pricing. Ufly Rewards Plus Tickets are subject to seat availability
at the time of booking.
3.g. First class upgrades made at the airport are charged the standard
rate to upgrade and are subject to availability. Purchasing a seating upgrade at
the airport does not change the ticket to a first-class ticket. All coach class
ticket rules and fees still apply.
3.h. Ufly Rewards Plus coach class tickets may be upgraded to first
class in advance for $139 per segment. Advance upgrades must be made one day before
travel. Regular Sun Country tickets or tickets purchased through another vendor
cannot be upgraded in advance for the Ufly Rewards Plus upgrade price.
3.i. Members are bound to Sun Country Airlines' scheduling and
availability. Scheduling and availability are subject to change without notice.
3.j. Members reserving tickets through Sun Country Airlines Reservations
Center will be assessed a $10 service fee. Sun Country Airlines may change this
fee structure without notice
- 4. CHANGE FEES
4.a. If a Member needs to make a change to his or her reservation,
there will be a change fee assessed. Please refer to http://www.suncountry.com/hometools/helpTicket.shtml
for the latest change fee rules. Sun Country Airlines may change this fee structure
without notice.
- 5. MEMBERSHIP BENEFITS OTHER THAN Ufly REWARDS PLUS TICKETS
5.a. Airport benefits such as access to first class security, first
class check-in, and first class boarding are all available at the Hubert Humphrey
Terminal in Minneapolis, MN. Access to first class security, first class check-in,
and first class boarding are all based upon availability at all Sun Country Destinations
other than Minneapolis, MN.
5.b. As a Member of Ufly Rewards Plus, you are entitled
to all of the benefits set out on the Site. The descriptions of all benefits displayed
have been approved by the relevant benefit Supplier.
5.c. As a registered Member of Ufly Rewards Plus, please
note that Suppliers of benefits and the Benefits themselves are subject to availability
and may change from time to time without notice.
5.d. By purchasing services from this Site, the Member agrees to
abide by the Terms and Conditions imposed by the Supplier whose services the Member
has selected.
5.e. Ufly Rewards Plus aims to ensure that the benefits
remain available at all times and are constantly negotiating new benefits to ensure
that you receive maximum use of your Membership. If any of the benefits become unavailable,
we will attempt to ensure that prior commitments are honored, but shall not be responsible
for any actions of Suppliers outside Ufly Rewards Plus' actual control.
- 6. TRAVEL SERVICES
6.a. Any services including package holidays, cruises, and hotel
arrangements purchased through Ufly Rewards Plus will be subject to the
terms and conditions of the holiday operator and the Supplier. Please note that
Ufly Rewards Plus is not an authorized travel agent or tour operator and
only acts as an introductory agent on behalf of the Supplier. All claims you have
are against the relevant Supplier.
- 7. LIABILITY
7.a. Your contract for the purchase of products or services is
made with the relevant Supplier only. Ufly Rewards Plus acts as an agent
for the Supplier and, unless expressly provided otherwise, all your claims are with
the Supplier.
7.b. You agree that any contract entered into by you with any of
the Suppliers is an independent contract. Ufly Rewards Plus hereby disclaims
any and all liability for any act or omission of any Supplier or any loss incurred
by you as a result of any act or omission of a Supplier whether or not arranged
through the Ufly Rewards Plus call center or Site. Ufly Rewards
Plus makes no warranties, expressed or implied, including the warranty of merchantability
or fitness for a particular purpose, with respect to any of the benefits or related
information.
7.c. Ufly Rewards Plus accepts no liability for any losses
or claims arising from any inability to access the Site or any failure to complete
a transaction.
7.d. Except as expressly provided for in these Terms and Conditions,
Ufly Rewards Plus shall not be liable for any loss, cost, expense, or damage
of any nature whatever (whether direct or indirect) resulting from the provision
of the Services or your reliance upon the information and suggestions provided by
Ufly Rewards Plus hereunder and the resulting supply of goods and services
to you by any third party.
7.e. Ufly Rewards Plus shall have no liability to you
for any loss, damage, costs, expenses, or other claims for compensation arising
from requests or instructions supplied by you which are incomplete, incorrect or
inaccurate, or arising from their late arrival or non-arrival, or any other fault
of you.
7.f. Ufly Rewards Plus shall not be liable to you or be
deemed to be in breach of these Terms and Conditions by reason of any delay in performing,
or any failure to perform, any of Ufly Rewards Plus' obligations in relation
to the Services, if the delay or failure was due to any cause beyond Ufly
Rewards Plus' reasonable control.
7.g. Under no circumstances shall our liability exceed your current
Membership fee and under no circumstances shall we be liable for your incidental
or consequential damages. We reserve the right to eliminate, add, change, and substitute
Benefits and participating vendors without notice to you.
7.h. Ufly Rewards Plus aims to ensure that viruses (or
other programs having adverse effects) do not reside on the Site, but Ufly
Rewards Plus accepts no responsibility for any virus or other malicious code that
a member may acquire from the use of the Site or from any Supplier site.
7.i. Your membership may be terminated without notice or refund
if: the airline ceases operations, an unforeseen natural disaster, or other extreme
circumstances.
7.j. This section applies only to the extent permitted by law.
- 8. CHANGES TO THESE CLUB RULES
8.a. Ufly Rewards Plus may vary these Terms and Conditions
from time to time and will notify you of any changes in a timely manner. Notification
will be by some or all of the following media:
i. The Ufly Rewards Plus
newsletter
ii. The Site
iii. E-mail
iv. By Mail
8.b. Your continued use of your Membership constitutes acceptance
of any altered Terms and Conditions with or without notice of these alterations.
- 9. COPYRIGHT AND TRADEMARKS
9.a. Ufly Rewards Plus owns or is lawfully entitled to
all of the copyrighted material in this Site. All other intellectual property rights
are reserved. This Site is for your personal use only-you may not use it for commercial
purposes. You may only download to your personal computer for viewing purposes and
print out a number of pages of this Site for your personal use. You may not modify,
copy, distribute, transmit, display, perform, reproduce, publish, license, create
derivative works from, transfer, or sell any information obtained from this Site.
9.b. All trademarks, product names and company names, and logos
appearing on this web site are the property of their respective owners.
- 10. LINKS
10.a. Ufly Rewards Plus assumes no responsibility for
the contents of any other web sites to which the Site has links and shall not be
held responsible or liable for any loss or damages caused or alleged to have been
caused by use of or reliance on any content, products or services available on such
hyperlinked sites. Ufly Rewards Plus may not have control of such web sites.
The inclusion of any hyperlinks to such other web sites does not mean that Ufly
Rewards Plus endorses the material on such web sites or has any association with
the owner thereof.
- 11. GOVERNING LAW
11.a. This Agreement and the Terms of Membership shall be governed
and construed in accordance with the laws of the State of Minnesota without giving
effect to the choice of law provisions thereof. Any dispute arising between Members
and Ufly Rewards Plus will be resolved by submission to arbitration in
Hennepin County, State of Minnesota in accordance with the rules of the American
Arbitration Association then in effect. Notwithstanding the foregoing, nothing in
this Agreement is intended or shall be construed to negate or otherwise affect the
consumer protection laws of the state in which Members reside.
